Regarding "COMMERCIALLY USEFUL
FUNCTION" or "CUF"
The DVBE
Resource Center contends that DGS should not arbitrarily decide what
determines a free enterprise marketplace for DVBE's.
During
FY 2005, DGS has reinterpreted CUF to be far more restrictive. Many
DVBE's have been questioned and/or lost contracts because they were
not deemed to perform an adequate CUF. A number of DVBE's have also
been decertified recently because of not being in compliance with
what we contend is the current unnecessarily strict definition of
CUF.
Suggested DVBE CUF Operational Parameters
1. The CUF definition for DVBE's should not be similar to California
Certified Small Business Enterprises/CSBEs because many of the DVBE
guys and gals are oftentimes fundamentally impaired or at least partially
so. Due to these impairments, e.g., vision, hearing, other physical
and psychological handicaps DVBE's should therefore have a more liberal
CUF definition in our humble estimation, it's only fair.

A proposed example of a DVBE's "CUF"
a. They shall have a city business license where their office is located.
b. They shall have a business checking account.
c. They shall have a Dba.
d. They shall have a resale certificate to provide supply.
e. They shall have a credit account with their supplier.
f. They shall provide a competitive price quote and invoice the prime
directly.
g. They shall automatically assume the transaction's financial liability
if the prime does not pay.
h. Transaction payments shall be proferred to them and they shall
pay their vendors directly.
